Important notice: these terms include a binding arbitration agreement and a class-action waiver. See the “Dispute resolution” section below.

These Terms of Service (“Terms”) govern every visit to impactwindowsanddoorsdavie.com and every service request submitted through it or by phone to Sightline Windows & Doors Davie. By using the site or submitting a request, a visitor accepts these Terms in full. Anyone who does not agree should not use the site or submit a request.

Appointments, cancellations and rescheduling

Once Sightline Windows & Doors Davie passes a service request to an independent business, all scheduling - including appointment times, cancellations and rescheduling - is handled directly between the visitor and that business. Each business sets its own notice requirements and determines whether a late-cancellation or no-show fee applies.

Visitors are asked to give the performing business reasonable advance notice when cancelling or rescheduling. Sightline Windows & Doors Davie can relay a cancellation message on a visitor’s behalf as a courtesy, but it has no authority over that business’s calendar and cannot guarantee any scheduling outcome.

How Sightline Windows & Doors Davie works

Sightline Windows & Doors Davie operates impactwindowsanddoorsdavie.com as a marketing and customer-referral business for home services in Davie, FL and surrounding areas. Its role is to advertise home services, receive service requests through the site and by phone, and route those requests to independent home-service businesses and the tradespeople who carry out the work on their behalf (collectively, “service providers”).

Every estimate, repair, installation and service call is performed by those service providers. Sightline Windows & Doors Davie does not perform home-service work of any kind. It does not employ the tradespeople who do that work, and it does not direct, oversee or control how any job is carried out. Scheduling, pricing, materials selection and the scope of any particular job are set entirely by the service provider that accepts the request. Availability of a service provider is not guaranteed.

Changes to these terms

Sightline Windows & Doors Davie may revise these Terms at any time. The date shown at the top of this page reflects when the current version took effect. Continuing to use impactwindowsanddoorsdavie.com or submitting a service request after a revision is posted constitutes acceptance of the updated Terms. Visitors should check this page periodically.

Warranties and workmanship

Because Sightline Windows & Doors Davie performs no home-service work, it gives no warranty or guarantee of any kind on workmanship, labor, parts or materials. The warranty on any job - to the extent one exists - comes solely from the independent business that performed it. Any parts or materials warranty comes from the manufacturer under that manufacturer’s own terms. Before work begins, visitors should ask the performing business for its warranty terms in writing.

If a customer is dissatisfied with completed work, Sightline Windows & Doors Davie will, as a courtesy, act as a go-between: it will contact the business that performed the work and ask that business to return and address the concern. This is a goodwill coordination effort only - it is not a guarantee of any particular outcome. Sightline Windows & Doors Davie will not perform, redo or repair any work itself, and it will not issue refunds of amounts paid to the performing business.

Indemnification

By using impactwindowsanddoorsdavie.com, the user agrees to indemnify, defend and hold harmless Sightline Windows & Doors Davie, its owners, officers, employees and affiliates, and each independent business in its referral network, from and against any and all claims, demands, actions, damages, losses, liabilities, costs and reasonable attorneys’ fees arising out of or related to:

• the user’s use of impactwindowsanddoorsdavie.com or its content;
• any information the user submits, including its accuracy and the user’s authority to provide any phone number included;
• the user’s breach of these Terms or of any applicable law; and
• the user’s interactions, transactions or disputes with any business to which the user is referred.

This indemnification obligation survives the termination or expiration of the user’s use of the site.

Independent businesses and limitations on Sightline Windows & Doors Davie’s liability for their work

The businesses and tradespeople that perform requested work are independent contractors. They are not employees, agents, representatives, joint venturers or legal partners of Sightline Windows & Doors Davie, and Sightline Windows & Doors Davie does not control them or the manner in which they carry out any job.

Sightline Windows & Doors Davie is not responsible or liable for the workmanship, quality, safety or timeliness of any work performed; for the pricing charged; for whether a business holds the required licenses or insurance; for the acts or omissions of a business’s own employees or subcontractors; or for any negligence, damage to property, personal injury or other harm caused by a service provider.

The service agreement or contract for any job is formed directly between the customer and the business that performs the work. Sightline Windows & Doors Davie is not a party to that contract. A referral from Sightline Windows & Doors Davie is not an endorsement, certification or guarantee of quality. Customers should verify a business’s licensing and insurance and review any written contract before authorizing work. Any dispute about the work itself is a matter between the customer and the business that performed it.

Dispute resolution

Please read this section carefully. It affects legal rights.

(a) Informal resolution first. Before starting any formal proceeding, a user must contact Sightline Windows & Doors Davie through https://impactwindowsanddoorsdavie.com/contact-us/ and give Sightline Windows & Doors Davie a reasonable opportunity to resolve the issue informally.

(b) Binding arbitration. Any dispute, claim or controversy arising out of or relating to these Terms or the use of impactwindowsanddoorsdavie.com that is not resolved informally will be decided by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Both the user and Sightline Windows & Doors Davie give up the right to litigate that dispute in court, except as provided below.

(c) Class-action waiver. All claims must be brought solely on an individual basis. Both the user and Sightline Windows & Doors Davie waive the right to participate in any class action, collective action, consolidated action, or any class or representative arbitration proceeding. An arbitrator may not consolidate more than one person’s claims or preside over any representative or class proceeding.

(d) Jury waiver. To the extent any proceeding is determined to go forward in court, both sides waive any right to a jury trial.

(e) 30-day opt-out. A user may opt out of this arbitration agreement by sending written notice to Sightline Windows & Doors Davie through https://impactwindowsanddoorsdavie.com/contact-us/ within 30 days of first accepting these Terms. Opting out does not affect any other provision of these Terms.

(f) Small claims and injunctive relief. Either side may bring an individual claim in small claims court if it qualifies. Either side may also seek injunctive or other equitable relief from a court of competent jurisdiction to address misuse of impactwindowsanddoorsdavie.com or infringement of intellectual property rights.

Limitation of Sightline Windows & Doors Davie’s liability

impactwindowsanddoorsdavie.com and the referral service are provided on an “as is” and “as available” basis. Sightline Windows & Doors Davie makes no warranty that a service provider will be available, will contact the user, or will produce any particular result.

To the fullest extent permitted by applicable law, Sightline Windows & Doors Davie is not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any lost profits, lost data or damage to property, arising out of or related to the use of impactwindowsanddoorsdavie.com or the referral service.

Sightline Windows & Doors Davie’s total cumulative liability for any claim relating to impactwindowsanddoorsdavie.com or the referral service is limited to one hundred dollars ($100.00) - or the amount the user actually paid Sightline Windows & Doors Davie, which is ordinarily zero - whichever is greater. This cap applies only to Sightline Windows & Doors Davie’s own conduct in operating the site and the referral service. Responsibility for the work itself - including any property damage, personal injury or financial loss arising from it - rests with the independent business that performed it, not with Sightline Windows & Doors Davie.

Governing law and venue

These Terms are governed by the laws of the State of FL, without regard to its conflict-of-law provisions. Subject to the arbitration agreement in these Terms, any court action that is permitted must be brought exclusively in the state or federal courts located in FL, and the user consents to personal jurisdiction in those courts.
